PITTSBURGH, Oct 6, 2003 (BUSINESS WIRE) -- Mylan Laboratories Inc. (NYSE:MYL) today announced that all claims pending against it in the consolidated, multi-district "Pharmaceutical Industry Average Wholesale Price Litigation" in the U.S. District Court for the District of Massachusetts have been dismissed with prejudice. The AWP litigation includes allegations that pharmaceutical manufacturers have improperly reported "Average Wholesale Price" information.

The court had previously ruled that, in order for AWP-related claims to proceed, the plaintiffs were obligated, at a minimum, to identify specific drug products of each defendant manufacturer, and identify the allegedly improper "AWP" information upon which they relied. The plaintiffs in this litigation, which include various states' attorneys general, health plans, public interest coalitions and individuals, did not identify any wrongdoing on Mylan's part. The action recently filed by the Massachusetts Attorney General against Mylan and twelve other generic pharmaceutical companies is also pending before the same court.

Mylan also announced that the U.S. District Court for the Western District of Pennsylvania granted partial summary judgment to Napro Biotherapeutics Inc. in a patent infringement suit regarding Mylan's paclitaxel product. Mylan's claims that Napro's patents are invalid and unenforceable remain pending before the court.
